Step 2: The second stage Compiled the following documents to apply for registration under sections 12A and 80G (both applications may be made concurrently or separately): -

  • Completely completed Form – 10A for registration under Section 12A;
  • Completely completed Form Form – 10G for registration under section 80G;
  • Registration Certificate and Memorandum of Agreement/Trust Deed (two copies – self-attested by the leader of the NGO);
  • NOC from Landlord (at the location of the registered office, if rented);
  • Copy of the NGO's PAN card;
  • Electricity bill / receipt for house taxes / water bill (photocopy);
  • A brief description of the trust's activities and evidence of its welfare activities, as well as a progress report for the last three years or since creation;
  • Accounting records, balance sheets, and income tax returns (if any), dating back to the company's founding or within the last three years;
  • List of donors, including their addresses and PAN (if applicable);
  • List of members of the governing body/board of trustees, including their contact information and a copy of their PAN;
  • Original R.C. and MOA / Trust Deed for verification (You will receive the originals back after verification);
  • Affidavit/undertaking of the head of the NGO.
  • Step 3: After assembling the following documents and attaching a covering letter, the responsible person shall provide the copies to the Commissioner of Income Tax for the county in where the NGO is located.
    Step 4: NGO would receive a letter from the Income Tax Department requesting clarifications within 2-3 months of applying.
    Step 5: The responsible person of the NGO will respond to the notice by submitting all necessary documentation to the Income Tax Departments.
